I brevetti

A patent protects and enhances a technical innovation, or a product or a process providing a new solution to a specific technical problem. It is a title in view of which a temporary monopoly on exploitation is conferred on the patent itself, consisting of the exclusive right to make it, dispose of it and commercially use it, prohibiting such activities to other unauthorised persons.

In particular, the patent confers to the owner:

  • in the case the subject of the patent is a product, the right to prevent third parties, unless admitted by the owner, from producing, using, marketing, selling or importing for these purposes the product in question
  • in the case the subject of the patent is a procedure, the right to prevent third parties, unless admitted by the owner, to apply the procedure, as well as use, market, sell or import for these purposes the product directly obtained with the procedure in question.

It is important to note that a patent does not attribute the owner the "freedom to use" or the right to exploit the technology covered by the patent, but only the right to exclude other subjects from using the same.
