The Patent Cooperation Treaty (PCT) or the Patent Cooperation Treaty is a multilateral treaty governed by the World Intellectual Property Organization (WIPO), which is based in Geneva.
The PCT procedure facilitates the obtaining of protection for its inventions in the Member States: by submitting an international patent application, applicants may at the same time request protection in a very large number of countries. The list of the 152 PCT countries is at the following link: http://www.wipo.int/pct/en/pct_contracting_states.htm

Formal examination, international research and, optionally, preliminary international examination are carried out once for all countries (international phase).

The PCT does not, however, eliminate the need to continue the procedure for issuing in the States and / or the designated Regional Organizations (national phase) individually.

The granting of the patent remains the exclusive competence of the designated national (or regional) office.

The end of the international phase decides to enter the national phases: usually deferred until the 30th month from the first deposit or priority date; this deferral is an appreciable advantage for assessing, with greater judgment, the convenience of continuing the procedure in countries of interest. The list of country time limits for entry into national / regional phases is available at the link: http://www.wipo.int/pct/en/texts/time_limits.html#note11.

For more information, we recommend reading the PCT Applicant's Guide prepared by WIPO for applicants worldwide, available at: http://www.wipo.int/pct/en/.

The Italian Patent and Trademark Office operates as an Italian Receiving Bureau for International Patent Applications (PCT) in which at least one applicant has Italian nationality or resident in Italy.
