Come registrare un brevetto

Before filing a patent application it is appropriate to make sure that the patent complies with the legal requirements and that it has all the required criteria, in particular that of novelty.
To this end it is useful to carry out a clearance search on the existing state-of-the-art (different from that provided by the office downstream of the application submission): with millions of patents granted worldwide and millions of publications available constituting the current state-of-the-art, there are evident risks that some documents or combinations of the same may make the invention not new or obvious and, therefore, not patentable. A clearance search that reveals the existence of publications or patents in the same field can prevent a futile investment of resources on a non-acceptable patent application.
A list of the intellectual property offices of different countries that have made their database on patents freely available on the network, can be found on the WIPO website. It is also possible to carry out a preliminary research on the database of the European Patent Office (EPO):
A research on the state-of-the-art can be made based on key words, classifications of patents or other research criteria; its success depends on the research strategy used, the classification system used, the technical knowledge of the researcher and the database used.

Another necessary step is the identification of the classes of pertinence of the patents for which the application is to be submitted, using the IPC or ECLA classifications.
